Pavilion Terms and Conditions

You MUST read and AGREE to the terms and conditions below before contacting Pavilion Web Design. By contacting Pavilion Web Design, you are agreed and bound by these terms and conditions listed below. These Terms and Conditions are subject to change without notice to you, therefore, you agree that you will keep up with any changes by coming to this page and checking for changes. You understand it is your responsibility to remain up to date with the Terms and Conditions of Pavilion Web Design.

1. We reserve the right to refuse any client. We will not design or take on any clients who have sites containing pornographic/adult material or sites which contain links to pornographic/adult sites, sites promoting or encouraging illegal activity, sites promoting or encouraging racism or hatred of any persons, sites providing instructions of performing or encouraging any illegal activities. We may, at our discretion, refuse or terminate service for any sites in which we consider inappropriate.

2. You will not violate or attempt to violate the system & network security, nor will you attempt any type of tampering with the system.

3. Payment may be divided into 4 payments equaling the total amount due. Invoices are due and payable upon receipt. All payments shall be made in U.S. currency.

4. When the full payment is satisfied, the site will be launched.

5. Renewal fee is due 14 days after email notification. The notification will come 14 days prior to your one year "live date". Your "live date" is the day upon which your web site is launched.

6. Pavilion Web Design does not undertake searches of any register of patents, trademarks, designs or other intellectual property. It is a condition of engagement that all such work be undertaken by the client, and all risk of breach of any third party rights in any of the mentioned categories shall be solely that of the client. It is also the responsibility of the client to ensure their own designs are protected by law or registration.

7. Virus protection and elimination is the responsibility of the client.

8. The client is responsible for protecting all account passwords and for any authorized or unauthorized use made of the client's account.

9. Client agrees to comply with the rules appropriate to any network to which Client may gain access via the services of Pavilion Web Design.

10. The client acknowledges that any proprietary, confidential, or otherwise valuable information that the client desires to keep confidential should not be transmitted over any part of the Internet, nor reside on computers connected to the Internet. The client will not transmit or make available to the Internet any material that is illegal, libelous, tortuous, or likely to result in action against Pavilion Web Design, or its clients.

11. All terminations of service or service changes must be in writing or via email within 30 days prior to termination or change to Pavilion Web Design. However, the client remains obligated to pay all amounts remaining and due to Pavilion Web Design. It is the client's responsibility to maintain all correspondence between the client and Pavilion Web Design.

12. Pavilion Web Design shall have the right, at any time, to pass through and invoice to the client any new or increased taxes, fees, assessments or other charges imposed on or required to be collected by Pavilion Web Design by any governmental agency.

13. In the event the client's account becomes past due, or is otherwise deemed insecure, Pavilion Web Design may, in its sole discretion, suspend, interrupt or disconnect the services. In the event of such suspension, interruption or disconnection, the client will be required to post the previously agreed upon amount due, as Pavilion Web Design deems necessary in order to resume receiving the services. Failure to satisfy Pavilion Web Design's request for such action within timelines set by Pavilion Web Design may result in immediate termination of service without further notice.

14. Proofs of all text, scripts and illustrations forming part of the work may be submitted for client’s approval and in that event the designer will have no liability for any uncorrected errors. Client’s corrections, additions or variations including alteration of style and the cost of additional proofs necessitated by such corrections may be charged in addition to the price on a time and materials basis.

15. The client warrants that any necessary permissions have been obtained for the agreed use of material or visuals supplied by the client or its customer and shall indemnify the designer against any and all claims and expenses including reasonable legal fees arising from the designer’s use of any materials provided by the client or its customer.

16. The designer shall retain ownership of all the work (including proofs and other materials except client’s images) delivered to the client.

17. Pavilion Web Design shall not be liable for delays caused by matters outside our control. Any times or dates quoted for the supply of the work are dependent on the client giving reasonable instructions to the designer and the client having made adequate preparations so that the designer can carry out the work.

18. Only the contact person or persons approved in writing by the contact person, may make any changes to the client's site or account.

From Pavilion

1. We will not sell or share with any other company the information you provide to us for the purpose of setting up and maintaining your web site.

2. We will try to the best of our ability to make this a professional and fun experience for you.

3. Pavilion Web Design shall use all reasonable endeavours to deliver the work to the client by the agreed date and shall notify the client of any anticipated delay at the first opportunity.

4. Except where the work is based on reference material or visuals supplied by the client or where otherwise agreed, Pavilion Web Design warrants that, as far as the designer is aware, the work is original and does not knowingly infringe any existing copyright.
